Self-employed borrower basics

Two of the most important things lenders review to qualify you for a mortgage are income and assets, which respectively, determine how much monthly payment you can afford and where your down payment is coming from.

When it comes to income, self-employed borrowers report income as sole proprietors or owners of entities like corporations, partnerships, or limited liability companies (LLCs).

As a sole proprietor, you will file your self-employed income on IRS Schedule C, which tracks your income and expenses for a given year.

Unlike with salaried employees, who get to use their gross income for loan qualifying, sole proprietor borrowers must qualify using their net income from Schedule C. Furthermore, lenders calculate a 24-month average of net income for sole proprietors (as opposed to sometimes requiring just one year from salaried borrowers), and if the most recent Schedule C has lower net income than the previous year, lenders will use worst-case income by calculating a 12-month average of the most recent year.

If you're self-employed and conduct business via a corporation, partnership, or LLC, the IRS requires these entities to file separate sets of tax returns. If you own 25 percent or more of the entity, you will need to provide lenders with these full business tax returns, as well as your personal returns.

Just like with Schedule C, lenders will average income for 24 months using two years of filed business (and personal) returns, and if the most recent year is lower, they will average 12 months of the lower year.

When it comes to assets, self-employed borrowers sometimes have a lot of their money in their business, and may want to use those funds for down payment. Some lenders will let you do this, and if so, they often require that your tax preparer verifies that use of business funds for a home purchase won't have a material impact on the business.

New rules for self-employed borrowers In February 2016, Fannie Mae updated self-employment income calculation guidelines for borrowers who own partnerships and S corporations. These guidelines impose stricter analysis on income and debt trends of a company to determine whether the company has sufficient assets to support the withdrawal of earnings to pay its owners.

If you own an entity like this, your income from the entity shows up on a form called Schedule K-1. This form is part of the entity's tax filing, and the figures on this form get carried over to your personal tax return as income.

This income most often comes in two main forms: "ordinary business income" and "distributions."

New rules for self-employed borrowers now impose conditions on whether you can use either of these forms of income. For example, if distributions are greater than ordinary business income, then ordinary business income may be used to qualify. But if distributions are less than ordinary business income (or distributions don't exist), then there are a host of guidelines to determine how you qualify.

These guidelines will be specific to your profile and they will vary by lender, so the best way to determine whether you qualify for a loan as a full or part owner of a corporation or partnership is to find a local lender who can analyze your tax returns for you.

Know Before You Owe 6 Questions To Ask Your Mortgage Lender

Shopping for a home loan is just as important as shopping for the home itself. Here's what you should "know before you owe." From weeding through paperwork to searching for optimal loan terms, purchasing a home can be as mentally taxing as navigating a foreign country without knowing the language. Let's face it: Channeling your energy toward finding the perfect home in Angel Fire, NM or Taos, NM, is a much more pleasurable experience than agonizing over potential lenders and loan applications.

Yet, the loan and lender you ultimately choose should be just as important as the neighborhood you explore or the home on which you put an offer; therefore, the amount of legwork for each chore should be comparable. In an effort to bolster consumer education, improve the loan-shopping process, and cut through the jargon on loan documents, the Consumer Financial Protection Bureau (CFPB) last year established the Know Before You Owe mortgage program. Prior to October 2015 and the start of Know Before You Owe, loan applicants would have received two forms upon applying for a loan: a Good Faith Estimate and a Truth-in-Lending disclosure. Created by two separate federal agencies and filled with overlapping information, the forms made it difficult for consumers to compare everything from loan amounts to interest rates.

With Know Before You Owe's streamlined Loan Estimate, it's easier to find pertinent loan information, which in turn can encourage comparison shopping instead of hindering the process. Seek details from lenders.

Once you've become familiar with the paperwork and application process, start interviewing lenders about their mortgage products. Here are six questions to ask.

1. Are points included in the quoted interest rate?

Points are upfront fees -- equal to 1% of the loan amount for each point -- paid to reduce the interest rate on the loan. It's important to clarify whether the quoted interest rate includes points and, if so, how many.

2. What are the closing costs associated with this loan? Closing costs typically fall between 2% and 5% of the total loan amount -- a large enough range to make this question an important one.

3. What is the required down payment?

A variety of loan types are available, and not all of them require the same down payment. Make sure to ask how much you will be required to put down and, if it's less than 20%, ask if tacking on Private Mortgage Insurance (PMI) will be an additional requirement.

4. Is it a fixed-rate or adjustable-rate mortgage?

A fixed-rate mortgage keeps your interest rate and mortgage payment locked for the entire duration of the loan (yep, all 15 to 30 years). An adjustable-rate mortgage (ARM) can adjust after a designated period depending on the market, potentially increasing your monthly mortgage payment substantially.

5. Can the interest rate be locked down? If so, for how long?

The interest rate offered by a potential lender isn't a guarantee -- unless the lender can lock it down for you. If you are offered a particularly low rate, make sure you know when you need to lock it down and how long it can be held.

6. Are there any prepayment penalties on this loan?

In exchange for a lower interest rate or lower out-of-pocket costs upfront, some lenders will charge a prepayment penalty. Depending on the terms, the prepayment penalty might have to be paid before refinancing or selling the home within a designated period. It's important to know beforehand exactly what your loan requires.

May is the best time To Sell a House

Why is May the best time to sell a house? We've asked real estate agents from several metro areas to chime in on why it's such a magical month for home sales.

1. The timing aligns with the new school year

If they intend to move, families really want to close on a new home before the end of summer. Why? Changing school districts after the school year starts is no picnic for anyone. If you take the month of May to search for a home, you can be closed in July or August, which gives you a little time to settle in before school.

2. Buyers are getting serious

When the spring housing season begins, typically right after Presidents Day in mid-February, many buyers feel as if they have plenty of time to find their perfect home and perfectly time their summer move. So they might bid more aggressively and offer less than asking price. If no sellers bite, though, by the time May rolls around, these same buyers may relent to submitting more competitive offers in the hopes of finally sealing the deal. Remember, though, that May is typically a seller's market. When buyers are just starting to look at this point, "They are excited and have not experienced the agony of defeat by being outbid once, twice, or three times -- at which point deal fatigue sets in. After missing several deals, buyers begin to feel as if they are settling and then begin to think that it would be better to just wait. As we move into late June and early July, in addition to being weary of looking, buyers make house hunting less of a focus for this year and more of one for next year.

3. The weather is beautiful

People normally discuss the weather for two reasons: When there's a huge weather event or natural disaster, such as a hurricane or tornado, or when they have nothing else to talk about. But there's actually a third reason: Weather plays an important role for home sellers and their open houses. People haven't left yet for summer vacation If you're selling to a clientele that typically "summers" elsewhere (lucky ducks!), you need to catch them while they're still around. 5. Tax refunds are burning a hole in buyers' pockets

Scraping up money for a down payment and closing costs can be quite a formidable undertaking. After filing your taxes, "You have a clearer picture of your financial situation. So when you get that big refund from Uncle Sam (if you're lucky), you might be in a better financial situation to buy. Or if you owe, you at least have that expense out of the way. What to look for at an Open House

You don't have to be a pro to know what to look for at an open house.

When you're on the hunt for a new house, weekends spent touring open houses can quickly veer from fun to daunting by house number three. Keeping track of which home had that great kitchen (but terrible master bath) versus the home with a terrible backyard but a great floor plan can be tough. And while no house is likely to be perfect, when it comes to your budget, some updates are harder to swallow than others. Unfortunate paint colors, though hard to see past, shouldn't sway your decision because they're easily changed. But other issues should give you pause because they'll require costly repairs, or they indicate larger, underlying problems that simply can't be fixed.

Read on for a list of things you should pay close attention to during an open house. Here's what to consider and what questions to ask when viewing a house.

1. How old is the roof?

"ou really need to look beyond the new kitchen and bathroom and consider the bones of the homeOne of the biggest "bones" of a house? The roof. The typical life span of a roof is up to about 20 years, but the average cost to replace one runs into the five-figure range, averaging about $12,000 but going up as high as $25,000 or more.

2. Are there issues with the home's foundation?

This is what everything is resting on -- literally. While superficial blemishes might not matter enough to affect a sale, if there are wide cracks in the foundation, it's most likely not worth the time and anguish that can come with fixing it.

3. What is the state of the sewer system?

When it comes to sewer and septic systems, many people are in the dark on a few elements: first off, their level of responsibility. If something goes wrong, it's the homeowner, not the city, who must cover damages (frequently through homeowners' insurance). The condition of the sewer lines is also something that is not part of a regular home inspection, so a few hundred dollars for a dedicated sewer inspection could prove to be a worthy investment.

4. Have insurance claims been made on the house?

Jensen also recommends asking if insurance claims have been filed on the house, and for what -- the answers may offer insight into any past issues that might not be immediately obvious at an open house. If the house is located near a pond, lake, or stream, he says, it's important to ask whether flood insurance is required, because that can affect buyer financing or create difficulties than can delay closing.

5. Is there noticeable water damage?

"While it may not be easy for a buyer to spot a wet basement, there are some signs you can look for at an open house, I fall of the utility systems and basement storage is propped up a few inches or more off the ground, that may be an indication that the basement has had water issues. This is one instance, where you should pay close attention to furnishings. If a basement has a nice, fresh carpet and furniture, and there's no musty smell, that's a likely sign the space has stayed dry.

6. How old is the wiring?

If you're considering an older home, don't ignore the possibility of outdated electrical systems and wiring. Older systems may still be functional but can pose a safety risk, can be difficult to insulate, and are sometimes hard to insure Another telltale sign of a potentially pricey upgrade? Old fuses with circular knobs in the fuse box (newer boxes have many small toggle switches).

7. How old are the windows?

Older, original windows often look great but can be painted shut or not airtight, which can make utility costs skyrocket in certain climates.

What are property easements

An easement gives a person or entity a legal right to use someone else's land. But that doesn't mean your neighbor can just start growing tomatoes in your yard. For example, a utility company might have the right to dig up a section of your lawn to install or maintain phone, power, and cable (maybe even fiber-optic) lines.

What should you know about easements before you buy? Start with the basics: It's important to know whether there are any easements on a property before you close, where they are, and what type of easements they are. Some easements, for example, remain after you buy the house, but others can be canceled. This depends on whether the easement is an appurtenant easement or an easement in gross.

"Appurtenant" means belonging to someone else. So an appurtenant easement is one in which the neighbor sought and now owns the easement, such as in the case of that driveway access. An appurtenant easement stays with the house if you buy it. With an easement in gross, you have more say. If, for example, the property has a path that leads to a fishing pond, the original owner might have granted a neighbor access to the property to get to the fishing spot. That's considered an easement in gross, and it does not remain once the property changes hands. So if you wish to put up a fence (or just don't want your neighbor traipsing across your property), you have the right to end the agreement -- just be prepared for an awkward first introduction with that new neighbor.

What are your property rights and easement rights?

If you buy a house with an easement, you'll need to play ball. Let's say you bought beachfront property (lucky you!) on a public beach. But what if your new property is the only access point the neighbors have to say public beach? You, in this case, would not have the right to block your neighbors from their fun in the sun by putting up a fence. If you did, you would be trespassing upon a right-of-way easement, also called an "easement by necessity," and you could be sued.

What are the limitations on renovations or expansions?

If you plan to build a new home or an addition, it's especially important to know whether there are any easements on a property before you buy. You can find out by looking over your paperwork. Written easements are contained in deeds, individual documents, on plats, and in condominium and homeowner association documents. Let's say your neighbor received an easement for their solar panels. You then cannot renovate, expand, or even plant a tree that would block your neighbor's sunlight access. Can easements be challenged? Easements can be challenged by [property] owners under specific circumstances. You would need to go to court to make that happen. If the easement holder agrees to terminate, it should be easy. In some cases, easements have an expiration date, which also would make ending the easement fairly easy. But other cases are more difficult.

For instance, you might have heard of "squatter's rights." There's a legal term for this: "prescriptive easement." This happens when a person has been openly using their neighbor's property for a certain length of time (which typically varies by state) without the owner's permission. This type of easement isn't on a title report, so buyers would most likely need to do a physical inspection to uncover an easement of this type. If you see your neighbors sunning themselves on a dock they constructed on your future lakefront property or they've put up a fence on your potential land, those would be big clues. Prescriptive easements can be challenged by allegations that [the land] has been abandoned. In this case, it might be a good idea to consult with a real estate attorney for advice.

The bottom line on easements

It's within your control to buy a house with an easement, so do your homework! Buyers need to exercise due diligence to make sure they know the extent of any possible easements.

What to do if a Seller Rejects your Offer

If you've fallen in love with a home, made the best offer and the seller won't cooperate, you might find yourself trying to figure out what to do.

There's no procedure or decree that says the seller must accept your offer, no matter how great it is relative to the market. Unlike a retail business that prices products based on inventory levels and market conditions, each seller is independent and has different selling motivations. Here are three ways to cope with a seller who's keeping you from your dream home.

1. Don't waste time questioning the seller

It's easy to ingest over the possible reasons why the seller rejected your offer. You could spend hours looking up a home's sales history and tax records, then combining that data with the information you received from the sellers' agent about their situation or motivations. Don't do it. Trying to figure out the seller won't get you anywhere. Worse, the time spent attempting to get inside the head of someone you don't know is precious time spent away from your home search. If the sellers "just aren't that into you," it may be time to move on. For all you know, like that elusive crush, they will come back once you pull away. Just don't count on it.

2. Put your best proposal on the table

Maybe you haven't offered the highest you can afford yet, wanting to keep some room for compromise. If you find that the sellers aren't responding positively to your offers so far, it could be a sign that they are not motivated to sell. Just because you're a real and active buyer wanting to purchase their house doesn't mean they have to accept your offer. If they're not answering, or they come back with a not-so-great counteroffer, cut to the chase. Make your maximum offer immediately and put it in writing. Then, if they still don't respond, start looking elsewhere.

3. Move On to the Next Home

Because purchasing a home can be both practical and emotional, it's easy for a buyer (particularly a new one) to get hung up on one house and have trouble moving on. But this can only keep you from getting the house you want. To be an understanding buyer, consider each experience and the lessons learned. Draw up unrealistic or unmotivated sellers to experience. Use that to your advantage the next time you make an offer. At the closing table weeks or months down the road, you'll likely look back on that home you "had to have" and realize that the home you ended up with is much better in the long run. Never forget that, no matter how much you believe this one was meant for you, there will always be another great house.

Taos Events:

Sat. March 14th starting at 10am:

Join New Belgium Mountain Adventure (formerly Scavenge) series this year at the Taos Ski Valley! This is a day to wear your best costume, chase chickens, search for Bigfoot and answer some crazy riddles all while skiing and bonding with your friends.. sign up as a team with 1-4 people, bring $10 per person and your ski pass, or purchase a lift ticket, and join the fleet of New Belgium characters on the slopes for a scavenger hunt like no other and enjoy great food and great times! All proceeds benefit local non-profits

PI DAY:

"3.1415!!" 2015 marks the rare occasion of the actual Pi Day! Saturday, March 14 Angel Fire Ski Resort will be celebrating all things PI, with pie eating contest at 1 p.m. at the base area, food and drink specials, nerd costume contest and live music at the Village Haus. Also the crowning of, King or Queen of the nerds announced at 9:26 (That's right, it's PI 3.1415 time!)

Monday, March 16:

Is Ugly Sweater Day! Come dressed in your craziest ugly sweater! Meet at the base of the Chile Express at 12 p.m. for prizes and pictures!

Tuesday, March 17:

Is the Luck of the Irish! Dress in your Green or Irish theamd costume for St. Patrick's Day and participate in this celebration, mountain style! Meet at the base of the Chile Express at 12 p.m. for prizes and pictures!

March 16-18:

From 11 a.m.-4 p.m. Try the Dos Equis Most Interesting Run and receive a free Dos Equis beverage at the Mountain Haus. The Dos Equis outdoor bar and grill will be open at the base area, so you can enjoy the sun, views, fun and of course cold beer.

Red River Events:

Wed. March 18th:

The Kids Glowstick Parade, located on "Gold Rush Hill", bring the family to the Main Chalet and enjoy FREE hot dogs and the Kids glowstick show and fireworks. 7pm for Hot Dogs, 8pm for the parade. At the Red River Ski Area! Followed by the adult TORCH LIGHT PARADE AND FIREWORKS! Meet us at The Face for our Spring Break Torch Light Parade, the biggest fireworks display of the season!
